KOREAN NATIONAL POSITION
CIVILIAN PERSONNEL FLIGHT OSAN AIR BASE

POSITION TITLE & GRADE: Attorney-Advisor, KGS-0905-12
SALARY: Between 36537 – 53143 won per hour (Total hourly compensation when bonuses are included.)
DUTY LOCATION: 51st Fighter Wing, Office of Staff Judge Advocate, Osan AB.
AREA OF CONSIDERATION: All current USFK employees (Priority Group 5). All registrants on the area reemployment priority list (ARPL) (Priority Group 6). Family members of US military and civilian employees of an agency of the United States whose duty station located in Korea (Priority Group 7). Outside Korean National Applicant (Priority Group 8 & 9).
NOTE: 1. USFK NAF employees newly hired on or after 1 Jul 2004 will be required to serve no less than one year in the position to which they are initially hired before they can voluntarily accept any other position. However, they may be allowed to move to other NAF positions within their employing command/activity.
2. Relocation allowance is not authorized for USFK employees selected from outside the commuting area.
MAJOR DUTIES: Must be an attorney admitted to the bar. Advise and assist commanders and the Staff Judge Advocate in all aspects of international law, particularly in criminal jurisdiction. Request the United States Air Force (USAF) and advocate command position at all conferences with ROA authorities. Analyze legal issues in regard to Korean law, regulation, decrees or directives and their effect upon the military community in all phases; recommend command position an action in interpretational disputes between ROK and USAF; provide legal opinions, oral or written, as required, to the Staff Judge Advocate, commanders, agencies, and personnel regarding Korean law, SOFA and international law. Review proposed regulations implementing SOFA and applicable Korean law. Draft and recommend required regulations. Advocate waiver of ROK primary jurisdiction in appropriate cases to the ROK District Prosecutor or personnel of the Ministry of Justice, as required to fulfill U.S. policies maximizing U.S. jurisdiction. Advise and assist the Staff Judge Advocate in interpreting the SOFA, as necessary; review proposal adopted by Joint Committee and advise commanders and the Staff Judge Advocate of status and effect of same upon USAF and the military community. Advise and assist military personnel, DoD employees, invited contractors and dependents of their rights under the SOFA and Korean law prior to and subsequent to interrogation by Korean authorities; contact for the retention of Korean attorneys to represent SOFA personnel in cases of asserted criminal jurisdiction; monitor the quality of representation of SOFA personnel by private counsel. Maintain library, files and records necessary for position and digest changes or initial promulgation of ROK law and international law which have an impact on USAF and the military community. Prepare monthly and annual SOFA reports in accordance with 7 AF and USFK directives. Advise and assist commanders and Staff Judge Advocates in all claims field with, by or against the United States, under SOFA. Deploy to incident/accident scenes with claims team and immediately respond to host governmental agencies to resolve incidents and advise personnel. Assist claims team in investigating, recommending disposition, and obtaining settlements of SOFA claims; obtain, release and resolve claims when possible. Verify information and review allied documentation submitted to ensure conformity with pertinent laws and regulations within prescribed time limits, jurisdiction, liability and appropriate authority. Interview and apprise claimants of sufficiency and legality of claims involving such matters as contract, personal injury or death, property loss or damage, resulting from aircraft accidents, military vehicle accidents and privately owned vehicles. Advise and assist commanders and Staff Judge Advocates in UCMJ actions; evaluate and review cases of concurrent jurisdiction, following waivers of ROK jurisdiction; recommend prosecution and/or disciplinary actions; draft charges pertaining to violation of ROK law for use in UCMJ or administrative actions; prepare subpoenas of ROK witnesses to ensure attendance of witnesses at USAF trials/proceedings. Provide legal assistance to military personnel, DoD employees and dependents. Assist and advise clients in matters relating to immigration, naturalization, adoption, divorce, nonsupport, contracts, torts and marriage under Korean law. Assist and advises clients in matters relation to immigration, naturalization, adoption, divorce, nonsupport, marriage and litigation under U.S. law. Advise and assist Staff Judge Advocates in the preventative law programs relating to labor, divorce, adoption difficulties, black marketing and other SOFA problems. Act as advisor, interpreter and translator in conferences or negotiations between military representatives and officials of Korean community, interpret and/or translate as appropriate from or into Korean and English, legal terminology, related to laws and other material or as directed by the Staff Judge advocate; act as interpreter in special and general courts-martial if required; locate and assist in preliminary examination of potential witnesses in the local community; prepare necessary documentation for payment of witness fees when required.
OTHER SIGNIFICANT FACTS: Position under the supervision of the Staff Judge Advocate, 51st FW. In these complex areas of international law, jurisdiction disputes, customs contract, claims and SOFA, this position involves the absence or precedent. The recommendation of this position has momentous impact upon the policies and personnel of the U.S. Air Force, Republic of Korea. Incumbent will also be subject to technical direction by the Staff Judge Advocate, 7th Air Force. Position requires flexible duty hours.
MINIMUM QUALIFICATION REQUIREMENTS:
BASIC REQUIREMENTS: Applicants must have passed the Korean Bar Examination or possess a license as an attorney by the ROKG.
EXPERIENCE: One (1) year of professional legal experience.
PROFESSIONAL EXPERIENCE: Experience which required application of the professional theories, scientific principles, and practices in the established profession of the position to be filled. Professional positions require professional, rather than technical knowledge, skills and abilities (KSAs) such as can be gained through intensive college education and training.
ENGLISH LANGUAGE COMPETENCY: 1. The American Language Course Placement Test (ALCPT) score of 80 or above and successfully passing the English Comprehension Interview (ECI) is required.
2. The Test of English as a Foreign Language (TOEFL) score of 550 and higher or the Test of English for International communication (TOEIC) score of 800 and higher may be substituted for ALCPT requirement. Applicant must submit the TOEFL/TOEIC official copies of test score. TOEFL and TOEIC scores are valid for two years from the exam date.
